1. Agreement to these Terms
These Terms & Conditions (“Terms”) govern your use of the website oakvane.com (the “Site”) operated by OakVane Properties LLC (“OakVane,” “we,” “us,” or “our”), a limited liability company organized under the laws of the State of Wyoming. By accessing the Site or submitting information through it, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
2. Who we are, and who we are not
OakVane Properties LLC is a real estate investment company. We buy, contract to buy, and market our contractual interests in residential real estate, and in some transactions we may assign our purchase contracts or work with sellers under other written agreements.
- We are not a real estate brokerage, and unless expressly stated in writing, we do not act as your agent, broker, or fiduciary.
- Nothing on this Site is legal, financial, tax, or investment advice. You should consult your own attorney, accountant, or advisor before signing any contract or making decisions about your property.
- Any general information on the Site (for example, descriptions of how direct sales work) is provided for education only and may not apply to your situation or your state.
3. Service area
We consider properties throughout the United States; however, we do not operate in South Carolina or in any other jurisdiction where our business model is restricted or where we choose not to transact. We reserve the right, in our sole discretion, to decline any inquiry or property for any lawful reason, including its location. Submitting the form does not guarantee that we will make an offer or enter into any transaction.
4. Offers and transactions
- Any figures, estimates, ranges, or proposals communicated by phone, text, email, or through the Site are preliminary and non-binding.
- No offer is binding on either party unless and until it is set out in a written purchase agreement signed by both parties. Either party may decline to proceed at any time before signing.
- All transactions are subject to our due diligence, inspection (in person or by a third party we designate), title review, and the terms of the signed agreement.
- Closing timelines, prices, and terms described on the Site are illustrative, not promises.
- In some transactions, we may assign our rights under a purchase agreement to another buyer, or enter into other written arrangements with you (such as a novation agreement), as permitted by applicable law and as described in the specific contract you sign. The signed contract, not this Site, controls.
5. Your submissions
When you submit information through the Site, you represent that:
- You are at least 18 years old;
- The information you provide is accurate and truthful to the best of your knowledge;
- You are the owner of the property you submit, or you are authorized by the owner (for example, as an heir, executor, or attorney-in-fact) to discuss it; and
- The phone number and email you provide belong to you.
6. Communications consent
By submitting your phone number with the consent box checked, you authorize OakVane Properties LLC to contact you by phone call and text message (including via automated technology) regarding your inquiry and our services. 7. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or to submit false, misleading, or fraudulent information;
- Submit information about a property or person you are not authorized to represent;
- Attempt to probe, scan, disrupt, or gain unauthorized access to the Site or its systems; or
- Scrape, copy, or republish Site content except for your personal, non-commercial use.
8. Intellectual property
The Site and its contents, including the OakVane name, wordmark, weathervane logo, text, graphics, and design, are owned by OakVane Properties LLC or its licensors and are protected by applicable law. No rights are granted to you except the limited right to view and use the Site as intended.
9. Third-party services
The Site may link to or integrate third-party services (for example, electronic-signature platforms or mapping tools). We are not responsible for third-party services, and your use of them is governed by their own terms.
10. Disclaimers and limitation of liability
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OAKVANE PROPERTIES LLC AND ITS MEMBERS, MANAGERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Nothing in this section limits liability that cannot be limited under applicable law, and nothing in these Terms limits either party’s rights or obligations under a separately signed purchase agreement, which is governed by its own terms.
11. Indemnification
You agree to indemnify and hold harmless OakVane Properties LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your submission of false or unauthorized information.
12. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute arising out of these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in [county], Wyoming, and you consent to their jurisdiction.
Signed purchase agreements may contain their own governing-law and dispute provisions, which control for that transaction.
13. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above shows the current version. Continued use of the Site after changes are posted constitutes acceptance.
14. Severability & entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site, but they do not replace or modify any separately signed contract concerning a specific property.
